These Terms & Conditions govern your use of the ALLCAREADVANTAGE.COM website. By using, visiting, browsing or purchasing from the ALLCAREADVANTAGE.COM website, you accept and agree to be bound by these Terms & Conditions. If you do not agree to these Terms & Conditions, you should not use the ALLCAREADVANTAGE.COM website or submit any order.

MEMBERSHIP AGREEMENT
On behalf of yourself and your dependents, if applicable, the following are the terms and conditions of membership.

By joining one of the ALL Care Advantage programs, you acknowledge that you have read, acknowledge and agree to (on your own behalf and on behalf of your enrolled dependents) the following terms and conditions:

1. DESCRIPTION OF PROGRAM FEATURES
ALL Care Advantage
programs are not health insurance policies and the program does not make payments directly to the providers of health services. The program member is obligated to pay the provider for all health care services that the member will receive.The member will receive a pre-negotiated discount from the providers listed in the network, in accordance with the specific pre-negotiated discounted fee schedules. These programs provide discounts at certain locations for health services.

 

2. MEMBERSHIP TERM
The initial Membership Term is 12 months.Your membership will become effective the date you join. The renewal membership term is 12 months.


3. AUTOMATIC RENEWAL OF MEMBERSHIP TERM
YOUR MEMBERSHIP WILL BE AUTOMATICALLY RENEWED TWO (2) WEEKS PRIOR TO THE EXPIRATION YOUR MEMBERSHIP.

At the expiration of your membership, we will automatically renew your membership for the initial term of your membership.If you DO NOT WISH to have your membership renewed you must cancel your membership 30-days prior to its expiration. In order to cancel your membership you MUST return your membership ID card to us: ALL Care Discoun Dental Plan, 2643 Gulf to Bay Blvd, 1560-417, Clearwater, FL 33759.


The automatic renewal will be charged to the same credit card that you provide in making your initial membership order or to the payment method indicated in your membership profile, should it be different.

4. CANCELLATION AND REFUND POLICY
If the member cancels the membership within the first thirty (30) days after joining the program and has not used the membership at a participating provider, member willreceive a refund of all membership fees paid to ALL Care Advantage. The one time application fee is NON-REFUNDABLE. In order to cancel the membership and receive a refund, cancellation request MUST be made in writing and membership ID Card must be returned to support@allcareadvantage.com. ID Cards are to be mailed to 2643 Gulf to Bay Blvd, 1560-417, Clearwater, FL 33759/span>.Cancellations requests made after the first thirty (30) days of joining are not eligible for a refund.

 

Member may cancel their membership 30 days prior to the expiration of membership to avoid membership being renewed automatically (refer to section 3. Automatic Renewal of Membership Term).


5. SHIPPING POLICY

A welcome letter and membership ID card will be mailed to new members within 45 days of joining.Letter and ID cards are mailed via the Unites States Postal Service.Temporary Membership ID cards are provided to new members on the confirmation page after successfully joining.Members may access and reprint their membership card by logging into their account and selecting �Membership Card�.


6. MEMBERSHIP PAYMENT/BILLING
Payment of the initial Membership Fee, application fee, if applicable, and/or any renewal Membership Fee will be made automatically by a charge against the Member�s credit card for the full amount of the Membership Fee for the Membership Term. Members who chose to pay Membership Fees by a direct charge against the Member�s Credit may not receive notice from ALLCAREADVANTAGE.COM of a subscription payment due, rather the Member will be notified of the billing on his/her credit card or checking account statement. Each Member hereby authorizes ALLCAREADVANTAGE.COM to bill and receive payment for the Membership Fee as set forth in the Agreement. ALLCAREADVANTAGE.COM reserves the right to increase the Membership Fee for a future Membership Term, in which case the Member will be notified of the increased Membership Fee, which will be effective upon renewal of the Program Membership.

In the event that ALLCAREADVANTAGE.COM attempts to automatically renew your membership but is unable to do so due to the cancellation or inactivation of your credit card or other form of electronic payment, ALLCAREADVANTAGE.COM will attempt to notify the member through the e-mail address on record. In all events, it is the responsibility of the member to ensure that ALLCAREADVANTAGE.COM has received payment for membership renewal four (4) weeks prior to the expiration date identified in the order confirmation. ALLCAREADVANTAGE.COM is not responsible and assumes no liability to any member for any member's failure to provide ALLCAREADVANTAGE.COM with current payment information for membership renewal.

7. MEMBER ACKNOWLEDGEMENTS
Membership in the Plan or Program and or Member�s rights or duties under this Agreement may not be assigned or delegated without the prior express written consent of ALLCAREADVANTAGE.COM. Member agrees that he/she will use his/her Plan or Program Membership only for his/her personal benefit or for the benefit of his/her Family Members (if Family Program is elected). A Member�s violation of this Paragraph may, at the discretion of ALLCAREADVANTAGE.COM, result in immediate termination of the Plan or Program Membership. ALLCAREADVANTAGE.COM bears no responsibility for the payment of or contribution to any use, sales or other tax that may be imposed on the dental services by any federal, state or other taxing authority. Payment of such taxes will remain the sole responsibility of the Member or the Provider of the dental services, as applicable. Member is responsible for paying Providers and/or vendors for all dental services rendered unless otherwise agreed upon by Member and Provider or vendor. ALLCAREADVANTAGE.COM in no way is responsible for the dental services provided by a Provider or vendor. The Program is not insurance and it may not reduce deductibles, co-payments or other out-of-pocket expenses for dental services that are covered by insurance.

Member�s Plan provides Member access to a network of participating dentists who are independent practicing dentists. Participating providers are independent contractors in private practice and are neither employees nor agents of ALLCAREADVANTAGE.COM and/or its parents, subsidiaries or affiliates ("ALLCAREADVANTAGE.COM"). The availability of any particular provider cannot be guaranteed, and provider network composition is subject to change without notice. ALLCAREADVANTAGE.COM does not provide dental, medical or any other treatment and is not responsible for outcomes. All dental, medical and/or other health care is the responsibility of the treating provider, in consultation with the Member. Your selection of the provider is also the responsibility of the Member and is not based on any representations by ALLCAREADVANTAGE.COM.

The dentists and providers participating in the respective Plans have agreed to make certain services and supplies available to Members on a "Reduced Fee Service" basis. The term "Reduced Fee Service" means a service that is available to a Member at a discount from fees normally charged by the provider and for which the Member is solely financially responsible. Member understands that all payments to providers are due and payable at the time of service, unless another payment arrangement is mutually agreed upon between the Member and the treating provider. Members may be subject to the treating provider's late payment and other office policies.

In order to access Reduced Fee Service rates, the Member must present his/her Program ID card to the provider's office at the time of his/her appointment. In the event any of the terms and conditions hereof are violated by Member, Member�s participation in the Plan or Program may be terminated immediately.

8. DISCLAIMER OF WARRANTIES:
ALLCAREADVANTAGE.COM IS NOT A MERCHANT, MANUFACTURER, OR A PROVIDER OF THE DENTAL SERVICES. ALLCAREADVANTAGE.COM DOES NOT GIVE ANY WARRANTY, EXPRESS OR IMPLIED, AS TO DESCRIPTION, QUALITY, MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, PRODUCTIVENESS, OR ANY OTHER MATTER, FOR ANY SERVICES OR MERCHANDISE PURCHASED OR RECEIVED BY A MEMBER FROM A PROVIDER OR VENDOR THROUGH HIS/HER MEMBERSHIP IN THE PLAN OR PROGRAM. MEMBER SHOULD NOT RELY ON ALLCAREADVANTAGE.COM�S SKILL OR JUDGEMENT IN SELECTING A PROVIDER OR VENDOR FOR THE SERVICES AVAILABLE TO MEMBERS. IN THE EVENT ANY PRODUCT OR SERVICE PURCHASED OR RECEIVED BY A MEMBER IS CANCELLED, MODIFIED, DEFECTIVE, OR OTHERWISE UNSATISFACTORY TO THE MEMBER, THE MEMBER WILL LOOK SOLELY TO THE PROVIDER, SELLER, MERCHANT, VENDOR OR MANUFACTURER OF THE PRODUCT OR DENTAL SERVICE FOR ANY REPAIR, EXCHANGE, REFUND OR SATISFACTION OF CLAIM.

9. INDEMNIFICATION
You agree to indemnify and hold harmless Allcareadvantage.com, its parent Ausar LLC, subsidiaries, affiliates, officers, directors, agents, employees, co-branders or other partners, and suppliers, from any claim, demand, action or damage, including reasonable attorney's fees, made or incurred by any third party arising out of or related to your use of the Site, any Content you transmit via the Site, or your violation of the Terms.

10. NOTICES
Any notice, consent, approval, complaint, request or other written communication given or required under this Agreement must be sent by first class mail, postage prepaid, or by an overnight delivery service such as Fed Ex or United Parcel Service, and addressed to the Member, at the address shown in ALLCAREADVANTAGE.COM�s records, or from the Member to ALLCAREADVANTAGE.COM, at:

11. Limitation of Liability
IN NO EVENT, INCLUDING WITHOUT LIMITATION, NEGLIGENCE, SHALL ALLCAREADVANTAGE.COM, ITS PARENTS, SUBSIDIARIES, AFFILIATES, AGENTS, OFFICERS, DIRECTORS, EMPLOYEES OR SUPPLIERS BE LIABLE TO ANY ENTITY FOR ANY INDIRECT, SPECIAL, EXEMPLARY, CONSEQUENTIAL OR OTHER DAMAGES (INCLUDING, WITHOUT LIMITATION, ANY LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION OR PROGRAMS OR OTHER DATA ON YOUR INFORMATION HANDLING SYSTEM) THAT ARISE OUT OF OR OTHERWISE ARE RELATED TO THE USE OF, OR THE INABILITY TO USE, THE CONTENT OR THE SITE OR ANY LINKED WEBSITE, THE STATEMENTS OF ANY THIRD PARTY ON THE SITE, OR UNAUTHORIZED ACCESS TO THE SITE, YOUR TRANSMISSIONS, YOUR ACCOUNT OR YOUR PASSWORD, EVEN IF ALLCAREADVANTAGE.COM IS EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

 

12. Copyright
All content included on the Allcareadvantage.com Web site, including text, graphics, logos, designs, photographs, button icons, images, audio/video clips, digital downloads, data compilations, and software, is the property of Allcareadvantage.com or its suppliers and is protected by United States and international copyright laws. The compilation of all content on this site is the exclusive property of Ausar LLC and protected by U.S. and international copyright laws. They should not be reproduced or used without express written permission from Ausar LLC

13. Choice of Law and Forum
The laws of the State of Florida shall govern the Terms, without giving effect to its conflict of laws provisions. Any claim or controversy arising in any way out of or relating to the Terms shall be filed in a court of competent jurisdiction sitting in City of Tampa, Florida. Both parties consent to exclusive jurisdiction in that county.


Plans and Programs offered by ALLCAREADVANTAGE.COM are not health insurance policies. Plans and Programs offered by ALLCAREADVANTAGE.COM provide discounts at certain health care providers for medical services. Plans and Programs offered by ALLCAREADVANTAGE.COM do not make payments directly to the providers of medical services. The Plan or Program member is obligated to pay for all health care services but will receive a discount from those health care providers who have contracted with the Plan, Program or discount plan organization.
